Pashtun Gems ("the Site," "we," "us," or "our") is a small online storefront selling rough gemstones, faceted stones, and mineral specimens sourced directly from Pakistan and Afghanistan. By using this site you ("you," "the buyer") agree to the terms below. If you do not agree, please do not place an order.

1. About Our Inventory

Every item we sell is described to the best of our knowledge based on direct inspection by our team or our trusted suppliers in the mining regions of Gilgit-Baltistan, Swat, Skardu, Mansehra, Nuristan, Kunar, Panjshir, and Badakhshan.

Stated weights, dimensions, colors, species identifications, treatments, and origins are made in good faith but are not laboratory-certified unless explicitly noted. For high-value purchases, we recommend that buyers obtain independent gemological identification or appraisal after delivery.

2. Photographs & Color Representation

We photograph items under natural daylight whenever possible. Color, clarity, and inclusions may appear differently on your screen due to monitor calibration, lighting in your viewing environment, and the inherent limitations of digital photography. We make every effort to represent each stone accurately but cannot guarantee that on-screen appearance will perfectly match the item in hand.

3. Shipping, Customs & Duties

We ship worldwide from Pakistan. Estimated delivery times depend on the destination country and the carrier used. Once a parcel leaves our hands, transit time is outside our control.

The buyer is responsible for any customs duties, import taxes, value-added tax (VAT/GST), brokerage fees, and other charges levied by the destination country. We cannot estimate these in advance and we cannot mark parcels as "gift" or undervalue them on the customs declaration.

4. Returns & Refunds

30-day satisfaction guarantee. If you are not happy with your purchase for any reason, you may return it within 30 days of delivery for a full refund of the item price. The stone does not need to be defective or misdescribed — if it isn't right for you, send it back.

To start a return, contact us within 30 days of delivery and we will provide a return authorization and a return address in the United States. Do not ship returns to Pakistan. Returns are sent to our U.S. return address (provided on request when your return is approved), so return postage is an inexpensive domestic shipment rather than an international one.

Conditions:

The item must be returned in its original, unaltered condition. Stones that have been cut, recut, heated, treated, mounted, or otherwise modified are not eligible.
The buyer pays return shipping to our U.S. address.
Original international shipping is non-refundable. We refund 100% of the item price; the shipping you paid to have the item sent to you is not returned.
Your refund is issued to your original payment method once we receive and inspect the returned item.

If an item arrives damaged or significantly different from its description, contact us within 30 days with photographs and we will make it right — in that case we cover the cost of return shipping as well.

5. No Warranty

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pashtun Gems, its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of this site, any purchase made through it, or any loss arising from shipment, customs handling, or third-party carriers.

7. Intellectual Property

All site design, branding, code, photographs, and original written content are the property of Pashtun Gems and may not be reproduced, distributed, or used without written permission.

8. Privacy

We collect only the information needed to fulfill your order — name, shipping address, email, and (when applicable) phone number. We do not sell or share customer data. Payment processing is handled by third-party providers (such as eBay, Payoneer, or a future checkout partner) under their own privacy policies.

9. Modifications

We may update these Terms at any time. Changes take effect when posted. Continued use of the site after changes are posted means you accept the revised Terms.
